What’s new for 2022

There is no limit on rent increases in Quebec for 2022. However, the Regie du Logement has published its recommended increase rates corresponding to the type of dwelling. If the landlord provides a tenant with proper written notice, both parties have to agree on the proposed amount in order for a rent increase to happen on a residential unit.

Recommended Rent Increase Guidelines

Rent Increase Notice

The length of time required for landlords to inform tenants of any rent increases depends on the term of the lease.

For tenancies of one year or more, the landlord is required to give the tenant at least 3 months notice before the rent increase can take effect

For tenancies of less than one year, the landlord is required to give the tenant at least 1 month notice before the rent increase can take effect

For tenancies that do not have a set end date, the landlord is required to give the tenant at least 1 month notice before the rent increase can take effect

Rent Increase Forms

Use the forms available from the Tribunal Administratif du Logement to give proper notice. Don’t forget, if you do not give proper notice, or do not come to an agreement with the tenant on the new rent amount, your tenant can dispute it within 1 month of receiving the notice.

If the tenant does not respond to the notice of rent increase, it is presumed that they have agreed on the new rent amount proposed by the landlord. If the tenant disputes the notice of rent increase, the landlord has 1 month after receiving the tenant’s notice of objection to apply to the Tribunal Administratif du Logement for a rent increase.
